eDipCorps Privacy Notice
Who we are
The Department of Foreign Affairs and Trade is the data controller for personal data processed through the eDipCorps Portal.
What the eDipCorps Portal is used for
We collect and process personal data submitted by foreign diplomatic missions via the eDipCorps Portal in order to:
- Process notifications of arrival, change of circumstances and departure of members of foreign diplomatic missions, private domestic employees and eligible accompanying family members under Article 10 of the Vienna Convention on Diplomatic Relations, 1961 (VCDR).
- Process notifications of arrival, change of circumstances and departure of employees of the Government of the United States of America, who are assigned to preclearance duties in Ireland pursuant to the 2008 Ireland – US Pre-Clearance Agreement, and eligible accompanying family members.
- Issue identity cards to accredited persons.
- Maintain accurate records of accredited persons for the purposes of the administration of privileges and immunities under the VCDR, as given effect in Irish law under the Diplomatic Relations and Immunities Act 1967 (as amended) and for the purposes of the administration of privileges and immunities pursuant to the 2008 Ireland – US Pre-Clearance Agreement and related exchanges of Notes, as given effect in Irish law under the Aviation (Preclearance) Act 2009.
- Maintain and update Ireland’s Diplomatic List. The Diplomatic List is maintained by the Department of Foreign Affairs and Trade and is published online on the Department’s website. It lists the name and diplomatic title of diplomatic staff members at each foreign diplomatic mission accredited to Ireland and, where applicable/requested, the names of their spouse/partner.
Lawful basis for processing
The legal bases for processing are:
- GDPR Article 6(1)(e) — processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller. The Department derives its official authority from the Ministers and Secretaries Act 1924 (Ministers and Secretaries Act, 1924).
- GDPR Article 6(1)(c) — processing is necessary for compliance with a legal obligation to which the Department is subject. Collecting and processing the personal data of members of foreign diplomatic missions, private domestic employees and eligible accompanying family members is necessary in order for the Department to fulfil its obligations under the VCDR as given effect in Irish law under the Diplomatic Relations and Immunities 1967 (as amended). Collecting and processing the personal data of employees of the Government of the United States of America, who are assigned to preclearance duties in Ireland pursuant to the 2008 Ireland – US Pre-Clearance Agreement, and eligible accompanying family members, is necessary in order for the Department to fulfil its obligations under the Agreement and related exchanges of Notes, as given effect in Irish law under the Aviation (Preclearance) Act 2009.
Information sharing with third parties
Data may be shared with other Irish Government Departments or agencies for general protocol purposes (e.g., to facilitate the participation of the diplomatic corps in official or State events or to facilitate arrival/departure courtesies). Data may be shared, where necessary and proportionate, with competent State authorities for security purposes, including the protection of diplomatic premises, personnel and official events, and as provided for under Sections 41 and 60 of the Data Protection Act.
Keeping data secure
The Department is fully committed to keeping all personal data submitted by foreign diplomatic missions safe and secure during administrative processes. The Department applies appropriate technical and organisational measures to protect personal data processed through the eDipCorps Portal.
Data retention
Personal data will be retained for as long as necessary to fulfil the purposes outlined above and in line with the Department’s record-keeping policies and obligations under the National Archives Act 1986 (as amended).
Rights of the individual in relation to personal data held by the Department
Individuals have rights under data protection law, including the rights of access, rectification, erasure, restriction, objection and data portability, subject to certain legal limitations.
